Under the Labour Code, the employer is responsible for paying its employees the full compensation that they are entitled to following the termination of their employment contract. In this context, it is to be expected that, if the worker is dismissed, the employer will pay him that amount.

The scheme now in place is intended to deal with situations which do not proceed as intended, that is to say, where the employer does not pay, in whole or in part, to the worker who has dismissed the compensation to which he is entitled.

By obliging the employer to make specific savings for the payment of compensation to which its workers are entitled in the event of dismissal and by establishing a mechanism to cover the remainder up to 50% of that amount, it is ensured that the dismissed worker will always receive at least half of the amount to which he or she is entitled.

The guarantee that this new scheme ensures cannot be triggered if the employer pays the worker an amount greater than or equal to 50% of the compensation to which he is entitled.
