If after the dismissal there is a court decision imposing the reinstatement of the worker and if the FGCT has already paid part of the compensation due for termination of the employment contact, the worker must within 30 days return to the FGCT the amounts that have been advanced by it.
The reimbursement of the amounts paid by the FGCT to the worker may be made by the total amount of the debt or in instalments, by agreement to be concluded with the FGCT.
The non-return of the amounts paid by the FGCT in the terms described above determines their enforced recovery, being considered debt equivalent to debts to Social Security.
